The petitioner is languishing in custody since 09.03.2015 in a case registered for the offences punishable under Sections 302/34, 354B, 448 of the Indian Penal Code and 3(2)(v) of SC/ST (Prevention of Atrocities) Act.

The specific accusation against Ram Ekbal Mahto to have stabbed the nephew of the informant, namely, Sufendra Sadai.

It is submitted by learned senior counsel for the petitioners that the post-mortem reflects only one penetrating injury and petitioners are only member of unlawful assembly.

Patna High Court Cr.Misc. No.27187 of 2015 (2) dt.31-07-2015 2/2 Moreover, the investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jhanjharpur, District - Madhubani in connection with Khutauna P.S. Case No. 19 of 2015.
