Learned counsel for the petitioner submits that the petitioner is a retired person and he has been denied his arrear of salary for the period, January and February, 2017 and from September, 2017 to January, 2018. He further submits that the petitioner has represented to the different authorities including the District Magistrate, Bhagapur for payment of the same mentioning therein that he is in dire need of money as he has to treat his wife and has also to incur expenses relating to education of his children.

In view of the above, let the District Magistrate, Bhagalpur should consider the case of the petitioner. If it is

Patna High Court CWJC No.23583 of 2018(2) dt.18-12-2018 2/2 found that he has already not been paid the amount and there is no hurdle in making payment, in such circumstances, the payment should be made to him within a period of four months from the date of receipt/production of a copy of this order. It is made clear that if the admitted amount is not paid to the petitioner within the aforesaid period of four months, it will carry compound interest at the rate of 8%. (Shivaji Pandey, J) rishi/- U
