1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Khagaria (Gangour) P.S. Case No.479/2024, registered for the offences punishable under Sections 96 of the B.N.S.S.
3. Learned APP at the outset submits that from perusal of the allegation as alleged in the FIR, it would manifest that the age of the victim is 12 years and from perusal of the pleadings made in the anticipatory bail application, it does not even remotely reflects that petitioner has disputed the age of the victim and allegation is of kidnapping for the purposes of marriage.
4. The learned counsel for the petitioner submits that petitioner has performed his marriage with the victim. It is also

No.47695 of 2025(2) dt.30-07-2025 2/2 submitted that statement of the victim was recorded under Section 180 of the B.N.S.S., wherein she has supported the case of the prosecution and has stated that she was forcefully taken by the petitioner, and thereafter, forced her to marry but then is not in a position to rebut the submission of the learned APP that victim is a minor aged about 12 years.
5. Considering the submissions made by the learned APP, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
6. The anticipatory bail application of the petitioner is rejected.
