JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 489(B), 489(C) of the Indian Penal Code.
It is alleged that petitioner was caught with 23 counterfeit notes, denomination of rupees one hundred each. Submission on behalf of the petitioner is that petitioner is a mason and as a matter of fact, he did some work of one Sonu Kumar, who had given the aforesaid counterfeit notes to him and moreover, petitioner is in jail custody since 15.12.2015 and does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as

No.19893 of 2016 (2) dt.06-05-2016 2/2 well as submissions of the parties and also taking note of this fact that investigation against the petitioner has already been completed, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Kumari Jyotshna, learned Judicial Magistrate 1st Class, Patna in connection with Ramakrishna Nagar P.S. Case No. 301 of 2015.
