JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-06-2015 The petitioner seeks bail in connection with Sessions Trial No. 116 of 2013/ 05 of 2015 arising out of Jehanabad (Krauna) P. S. Case No.421 of 2001 registered for the offence punishable under Sections 302 read with 34 and 201 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 23.07.2014 passed in Cr.Misc. No. 24549 of 2014 with following observations :- "The learned Sessions Judge, Jehanabad is directed to expedite the trial and conclude the same as early as possible preferably within a period of nine months from the date of receipt/production of a copy of this order failing which the petitioner would be at liberty to renew his prayer for bail." It has been contended that though the charges were framed on 02.09.2013 and two witnesses were examined before

Patna High Court Cr.Misc. No.24831 of 2015 (2) dt.24-06-2015 2/2 the trial court prior to 23.07.2014 but after that no other witness on behalf of the prosecution has turned up during trial. It has also been contended that there is no eye witness to the occurrence and the petitioner has been remanded to judicial custody on 14th August, 2012 merely on suspicion and since then he is jail. Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jehanabad in connection with Sessions Trial No. 116 of 2013/ 05 of 2015 arising out of Jehanabad (Krauna) P. S. Case No.421 of 2001.
