The petitioner seeks bail in connection with Lakhisarai P.S. Case No. 454 of 2013 registered for the offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code and Section 17, 18, 18(b), 21, 38 and 40 of the UAPA Act.

Allegedly, acting on an information, a raid was conducted and thereafter four persons were arrested and from their possession, several ATM cards and other bank papers besides mobile were recovered and it is alleged that the petitioner is operating the gang and used to open fake bank account in the name of different persons and transactions are made for terrorist

Submission is of false implication and that the petitioner was not arrested on the spot, nothing has been recovered from his conscious possession, there is no legal and cogent material against the petitioner, in this case the persons who were arrested have already been allowed bail vide Criminal Misc. No. 10921 of 2014, 16532 of 2014, 18346 of 2014 and 31457 of 2014 by different benches of this Court and the petitioner having no criminal antecedent is suffering in custody since 15.02.2016 The learned A.P.P submits that the petitioner is the gang leader.

In the facts and circumstances stated above, considering the chargesheet has already been submitted and there is no chance of tampering with prosecution evidence and, as such, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 454 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on
