JUSTICE BIRENDRA KUMAR ORAL ORDER 07-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offence punishable under Section 306 of the Indian Penal Code. The FIR would reveal that the daughter of the informant was in love with the petitioner; rather she was pregnant from this petitioner. The petitioner was not ready to marry with her. In the circumstances, she committed suicide. Submission of the learned counsel for the petitioner is that no ingredient of abetment to commit suicide is made out against the petitioner because the suicide was personal decision of the victim might be due to frustration of some affairs but it cannot be said that the petitioner actively participated in
Patna High Court Cr.Misc. No.12923 of 2018 (2) dt.07-03-2018 P2/ pursuing the victim to commit suicide.
Learned counsel for the informant vehemently opposed the prayer for bail.
Considering the fact that for the purpose of this bail no substantial case is made out against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gaya Kotwali P.S. Case No.440 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
