The petitioner apprehends his arrest in connection with Parbatta P.S. Case No.92 of 2019 registered under Sections 366, 366(A) and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case being elder brother of co-accused Rahul Kumar. The victim in her statement recorded under Section 164 of the Cr.P.C. has specifically stated that she has not been kidnapped by anyone. She had love affair with Rahul Kumar with whom she has voluntarily married (vide Annexure 2 to this petition). The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.49225 of 2022(5) dt.24-04-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.- III, Naugachia, Bhagalpur in connection with Parbatta P.S. Case No.92 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
