====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-08-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 65(2), 69, 87, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, co-accused Nageshwar Kumar, on the pretext of marriage, made physical relation with the complainant. After sometime, marriage negotiation failed. Thereafter, complainant requested these petitioners, who are father and mother of said co-accused, to settle her marriage with co-accused Nageshwar Kumar, but these petitioners abused her and also threatened her to kill.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.49509 of 2025(2) dt.06-08-2025 2/2 these petitioners have been roped in this case only because they are parents of co-accused Nageshwar Kumar. No specific overt act has been alleged against these petitioners. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Bagaha West Champaran in Valmiki Nagar Police Station Case No. 21 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
