The petitioner seeks regular bail in connection with Mahila P.S.Case nO.47/2016 arising out of Mahila P.S.Case No.47/2016 registered for offences punishable under Sections 443, 376, 506, 342/34 of the Indian Penal Code. Allegation against the petitioner is of committing rape upon the minor prosecutrix.

Submission of the learned counsel for the petitioner is that he is in custody for 02 years and 09 month but the trial has not been concluded, however, he has admitted that two witnesses have been examined and for third witness, who is I.O., the case had been fixed on 7.6.2019.

Heard learned A.P.P. also.

No.45750 of 2019(2) dt.25-07-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner , however, the learned trial court is directed to expedite the trial and try to conduct it on regular basis as he is in custody for 2 years and nine months.

With the aforesaid observation, this application is dismissed.
