JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 10.12.2015 in a case registered for the offences punishable under Sections 498A, 326 and 307/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. Subsequently, section 304B IPC was added. The accusation is of killing the daughter of the informant after four years of marriage by causing burn injury for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the victim died due to accidental fire and several independent witnesses have not supported the prosecution case.

No.18060 of 2016 (3) dt.16-05-2016 2/2 It is submitted by learned counsel for the informant that the victim was killed within four years of marriage and there has been demand of dowry and unnatural death is admitted, hence the petitioner being husband of the victim does not deserve bail. Considering the nature of accusation, this court is not inclined to grant bail to the petitioner in connection with Mirganj P.S. Case No. 283 of 2015 pending in the court of learned CJM, Gopalganj.

This application is, accordingly, dismissed.

However, let the trial be expedited.
