Petitioner, already in custody, seeks bail in connection with Motihari Mufasil P.S. Case No.585 of 2017, registered under Sections 341, 342, 323, 324, 307, 504 and 506 of the Indian Penal Code. Section 302 of the Indian Penal Code was added later on.

Allegation is that due to dispute of a tree, Dilip Mishra assaulted with axe over the head of the deceased and the petitioner is said to have given blow with hard and blunt substance.

Learned counsel for the petitioner submits that there is land dispute between both sides, the specific overt act of giving axe

No.14808 of 2018(2) dt.15-03-2018 2/2 blow is against Dilip Mishra and that is the cause of death as per the post-mortem report, petitioner is a lady and she is in custody since 02.11.2017 Having considered the said facts and circumstances, petitioner Arun Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Motihari Mufasil P.S. Case No.585 of 2017.
