JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioner is languishing in custody since 18.4.2015 in connection with Jamui Mahila P.S. Case No.19 of 2014 for the offences instituted under Sections 376(G) and 325 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that there is allegation against the petitioner along with other co-accused of committing rape upon the complainant on the premise of providing her a job. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.4.2015.He has no criminal antecedent. The petitioner and the informant are Devar and Bhabhi. It is further submitted that the alleged date of occurrence

Patna High Court Cr.Misc. No.24866 of 2015 (3) dt.19-08-2015 2/2 is 14.10.2014 in respect of which a complaint was filed on 2.1.2014. But no explanation for delay in filing the complaint has been made on the part of the informant.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jamui, in connection with Jamui MahilaP.S.
