The petitioner apprehends his arrest in Barahat (Krishnagarh) P.S. Case No. 230/2017, registered for the offences punishable under Sections 307, 379, 384 and other sections of the Indian Penal Code.

The informant alleged that the petitioner demanded fish from him, when the informant disclosed that he had already sold the entire fish, the petitioner insisted to give him fish after purchasing from other fisherman and on refusal, the petitioner is said to have assaulted the informant with iron rod on his head. Learned counsel for the petitioner submits that some altercation took place on account of land dispute. Only one lacerated wound was found on the head of the informant. Mohan

No.57297 of 2017 (2) dt.02-01-2018 2/2 Yadav is also said to have assaulted the informant, but no corresponding injury was found, but from perusal of the F.I.R. and the injury report, it appears that the petitioner is alleged to have assaulted the informant with iron rod only when the informant could not be able to provide him fish.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
