The present application has been filed for modification of the order dated 18.10.2017 passed in Cr. Misc. No. 50253 of 2016 by which the provisional bail granted to the petitioner in connection with Kotwali P.S. Case No. 380 of 2016, pending in the court of learned Chief Judicial Magistrate, Patna, was cancelled and the petitioner was directed to surrender in the court below within a period of eight weeks.

Learned counsel for the petitioner submits that due to some unavoidable reason the petitioner could not surrender in the court below well within time. It is also prayed on behalf of

Patna High Court Cr.Misc. No.61673 of 2017 (2) dt.03-01-2018 2/2 learned counsel for the petitioner that further time may be extended so that the petitioner could surrender in the court below. Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, I am not inclined to grant any relief to the petitioner.
