Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On the basis of forged certificates, petitioner, who was a Peon succeeded in having himself promoted as Clerk. It has been submitted on behalf of petitioner that after tracing about use of forged certificates, the basis of promotion, he was proceeded under departmental proceeding and vide Annexure2, he has been punished. It has also been disclosed that in pursuance of order (Annexure-2), the payment made to the petitioner being a Clerk has been realized from his retrial benefits. Furthermore, petitioner happens to be under custody since 18.03.2015.

Patna High Court Cr.Misc. No.17856 of 2015 (02) dt.20-05-2015 On the other hand, learned Additional Public Prosecutor opposed the prayer.

Accordingly, petitioner, Md. Shamim Ahmad @ Md. Shamim is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P. S. Case no.99 of 2013.
