Petitioner is languishing in custody since 13.03.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 150, 114, 186, 353, 332, 333, 427, 436, 341, 323, 380, 302 of the Indian Penal Code. It is alleged that the truck collided with a motorcycle resulted into death of eight persons and caused injuries to several persons. Consequently, a mob of several persons made protest by pelting stones and put the alleged truck on fire when police went to pacify the mob, the mob pelted stones on the police personal also and damaged other vehicles. The name of the petitioners suggested by the local Chaukidar on subsequent enquiry and for the same occurrence three cases i.e. Buxar (T) P.S. No. 117 of 2015,
Patna High Court Cr.Misc. No.25242 of 2015 (2) dt.21-07-2015 Buxar (T) P.S. Case No. 118 of 2015, Buxar Industrial P.S. Case No. 32 of 2015 were registered by the police. It is submitted by the learned counsel for the petitioners that accusation is against the mob and only on suspicion the petitioners have been roped in the present case when the police in order to save their skin lodged the case. Considering the fact that investigation has already concluded and accusation is against mob, let the above named petitioners, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar Industrial Area P.S. Case No. 32 of 2015.
