In this case, the petitioner is seeking regular bail in connection with Amas P.S. Case No.11 of 2016, registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and under Section 25(1-b) A, 26/35 of the Arms Act. While the police was ticking around, identified one Sumo Car moving in suspicious circumstances. The police intercepted the said car and upon search all the occupants were found with gun of different nature.

Learned counsel for the petitioner has produced some orders passed by this Court such as Criminal Miscellaneous No.11857 of 2016, Criminal Miscellaneous No.13203 of 2016, Criminal

Patna High Court Cr.Misc. No.18296 of 2016 (2) dt.03-05-2016 2/3 Miscellaneous No.11809 of 2016 and Criminal Miscellaneous No.10575 of 2016, by which 11 co-accused persons have been granted bail.

It appears that nothing was recovered from the possession of the petitioner and the petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the petitioner-Pintu Paswan be released on bail on furnishing bail bond of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Sherghati (Gaya), in connection with Amas P.S. Case No.11 of 2015 subject to the conditions that:- (i) one of the bailors will be a close relative of the petitioner;

(ii) if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to make prayer for cancellation of his bail and the Court below will pass necessary order, including cancellation of bail;

(iii) that the petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates without reasonable explanation, the court below will be at liberty to cancel the bail bonds of the petitioner and;

(iv) that the petitioner will mark his presence

Patna High Court Cr.Misc. No.18296 of 2016 (2) dt.03-05-2016 3/3 before the nearest post station by 7th of every month till six months.
