This application for regular bail arises out of N.H. Bangra P.S. Case No. 8 of 2020, disclosing offences punishable under Sections 25(1-A), 25(1-AA), 25(1-AC), 25(1-b) A, 26(i) (ii) and 35 of the Arms Act.

The petitioner's prayer for grant of regular bail was earlier rejected by an order of this Court dated 05.02.2021, passed in Cr. Misc. No. 32301 of 2020. He is in custody since 23.01.2020.

Learned counsel appearing on behalf of the petitioner has drawn my attention to the orders of this Court dated 23.02.2021, passed in Cr. Misc. No. 30685 of 2020 and

Patna High Court CR. MISC. No.58695 of 2021(2) dt.01-12-2021 2/2 25.06.2021, passed in Cr. Misc. No. 3389 of 2021, whereby other persons named in the FIR have been allowed regular bail, considering the period of their respective custody and nature of accusation. He has submitted that no charge has been framed till filing of the present application.

Considering the fact that the petitioner is in custody since 23.01.2020 and other persons named in the FIR have been allowed regular bail by this Court, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Samastipur, in N.H. Bangra P.S. Case No. 8 of 2020.
