2. The petitioners apprehend their arrest in connection with Sirari P.S. Case No. 30/2025 for the offences punishable under Sections 126(2)/115(2)/117(2)/109/303(2)/352/351(2) and 3(5) of the BNS.
3. As per the F.I.R., the petitioner No. 2 (Kunal Kumar) along with his brother Shivam Kumar assaulted the informant with Lathi and Danda under the order of petitioner No. 1 (Anjila Kumari) due to which the informant sustained injury.

4. Learned counsel for the petitioners submits that the informant of the case is own uncle of the petitioner No. 2 and brother-in-law of the petitioner No. 1. The husband of the petitioner No. 1 and father of petitioner No. 2 is traceless for about 12 years. It has further been submitted that the petitioners are demanding their share in the joint family property and the same is being used by the informant. The petitioner No. 1 is a Guard in the Health Centre and maintaining her both sons. He further submits that the informant fell down when cows and buffaloes pushed him in the cowshed due to which he sustained injury. The allegation of assault by lathi is false and fabricated. He next submits that the petitioner No. 2 is studying in B.Sc., Zoology (Hons.) in SKM College, Nawada and is aged about 19 years. Petitioners have clean antecedent.

On the other hand, learned Additional Public Prosecutor appearing and the informant have vehemently opposed the prayer for bail and submits that there is specific allegation that petitioner No. 2 along with his brother (coaccused Shivam Kumar) assaulted the informant with Lathi due to which he sustained grievous injuries as is evident from the impugned order itself.
6. Regards being had to the submissions made by the

No.49150 of 2025(2) dt.12-08-2025 3/3 parties and taking into consideration the fact that both the parties are closely related and also the fact that the petitioner No. 1 is a lady and petitioner No. 2 is studying in B.Sc., and is aged about 19 years, I am inclined to grant bail to these petitioners.

In view of the above, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Principal and District Sessions Judge, Sheikhpura or the concerned Court in connection with Sirari P.S. Case No. 30/2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482(2) of BNSS, 2023. (Anil Kumar Sinha, J) Saif/- U T
