The petitioner is languishing in custody since 13.03.2015 in a case registered for the offences punishable under Sections 379/511 of the Indian Penal Code.

On theft of the motorcycle of the informant FIR was lodged against unknown. The name of the petitioner sprang up on confession of the co-accused during investigation and the motorcycle alleged to have been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that actually the recovery was not made from the

Patna High Court Cr.Misc. No.24478 of 2015 (2) dt.21-07-2015 2/2 petitioner but it has been thrust upon against the petitioner as only the number plate of the alleged motorcycle was recovered from the house of the petitioner.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that the investigation has already concluded and the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tatarpur) P.S. Case No. 144 of 2015.
