The petitioner is accused in connection with Lakhisarai (Kabaiya) P.S. Case No. 54 of 2016, registered under Sections 406, 419, 420, 467, 468 and 379/34 of the Indian Penal Code.

The accusation is that petitioner along with one Santosh Kumar were apprehended by the Police with a motorcycle bearing Reg. No. BR-27C-8856. On search, the petitioner was found in possession of 11 ATM Cards and a mobile set.

Learned counsel for the petitioner submits that the petitioner and other co-accused Santosh Kumar were apprehended by the Police showing recovery of A.T.M. Cards and a motorcycle bearing Reg. No. BR-27C-8856. Further

Patna High Court Cr.Misc. No.17652 of 2016 (3) dt.18-05-2016 2/2 submission is that in course of investigation, the said motorcycle was found in the name of the brother of the petitioner, whereas both SIM which is said to be recovered from the possession of the petitioner is also belong to the brother of the petitioner vide para 30 and 32 of the case diary. The petitioner having no criminal antecedent is in custody since 06.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 54 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
