Petitioner seeks bail in a case registered under sections 399, 402, 414 of the Indian Penal Code as well as various sections of the Arms Act.

One magazine containing seven live cartridges, mobile phone and one motorcycle are said to have been recovered from conscious possession of the petitioner when petitioner and others assembled to make preparation for committing crime. The contention on behalf of the petitioner is that mobile phone and motorcycle belong to the petitioner and so far as recovery of cartridges are concerned, petitioner is in jail custody since 17.1.2016 and moreover, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well

Patna High Court Cr.Misc. No.16988 of 2016 (2) dt.29-04-2016 as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Barhara P.S. Case no. 15/2016.
