The petitioners are apprehending arrest in a case registered for the offences punishable under sections

Patna High Court Cr.Misc. No.16186 of 2014 (7) dt.18-03-2015 2/3 147,148,149,342,307,302,450 and 452 of the Indian Penal Code, section 27 of the Arms act and sections 3 and 4 of Explosive Substances Act.

It is alleged that on the order of Rajiv Kumar Rai alias Manjay Kumar, Sanjay Kumar Rai alias Pappu Kumar caused fire arm injury on the chest of Ganesh Prasad who succumbed to the injury on the spot when Suma Devi reached on the spot after hearing of the occurrence, then she was caught hold by the petitioners and on the order of Ram Swaroop Prasad, the petitioners fired at Suma Devi causing injury in her arm and abdomen who succumbed to the injury. It is submitted by learned counsel for the petitioners that due to inimical relationship the accusation has been levelled against the petitioners.

It is submitted by learned counsel for the informant that there are specific accusations against the petitioners and anticipatory bail application of order giver Ram Swaroop Prasad has been rejected vide Cr. Misc. No. 26471 of 2014.

Considering the aforesaid facts, this court is not inclined to grant anticipatory bail to the petitioners in

Patna High Court Cr.Misc. No.16186 of 2014 (7) dt.18-03-2015 3/3 connection with Fatehpur P.S. Case No. 217 of 2013 pending in the court of learned C.J.M., Gaya. These applications are, accordingly, dismissed. (Dinesh Kumar Singh, J) Anil/- U T
