In this case, the petitioner is seeking anticipatory bail in connection with Phulwariya P.S. Case No. 52 of 2019, registered for the offence under Sections 447, 323, 324, 325, 326, 307, 379, 504 and 506/34 of the Indian Penal Code. Allegation has been made that while the informant was sitting at his door, the accused persons came there holding different weapons and started demolishing his wall and when the family members of the informant objected, the present petitioner gave order to kill all the family members. It has also been alleged that petitioner has inflicted sword blow on the Bhabhi of the informant.

Patna High Court CR. MISC. No.46163 of 2019(2) dt.26-07-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
