JUSTICE AMARESH KUMAR LAL ORAL ORDER 20-05-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek bail in a case registered for the offence punishable under Sections 144, 341, 342, 436 of the Indian Penal Code and 17 of the C.L.A. Act. It is submitted that name of the petitioners has not been mentioned in the F.I.R. Their name has appeared during investigation.

The confessional statement before the police has led to no recovery. However, after investigation chargesheet has already been submitted, the case has been committed to the court of Sessions and it has been fixed for framing of charge. The petitioners are in custody since 8.2.2013. Learned counsel for the State submits that both the petitioners have criminal antecedents.

Considering the facts and circumstances of

Patna High Court Cr.Misc. No.11519 of 2015 (2) dt.20-05-2015 2 / 2 this case, the above-named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 5th Addl. Sessions Judge, Saran at Chhapra in S. T. no. 420 of 2013 arising out of Nayagaon P.S. Case No.36 of 2012 after framing of charge with the following conditions :

1. One of the bailors will be the close relative of the petitioners.

2. The petitioners will not indulge in similar or in any other offence.

3. The petitioners will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bonds will be liable to be cancelled by the court concerned.
