The petitioner wants to renew the prayer of bail which was earlier twice rejected vide order dated 07.01.2016 and 09.11.2016, passed in Cr. Misc. No. 40518 of 2015 and 44767 of 2016 respectively, on the ground that the petitioner is suffering in custody since 18.02.2015, uptill now, the trial has not been concluded and in near future it is not likely to be concluded. The identification of the petitioner from CCTV footage is doubtful and, as such, he deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of bail by submitting that the prayer for bail of co-accused Anil Paswan @

Patna High Court Cr.Misc. No.12562 of 2018(3) dt.18-04-2018 2/2 Bhura has been again rejected by another coordinate Bench of this Court.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected in connection with Sessions Trail No. 39 of 2016, arising out of Kotwali P.S. Case No. 765 of 2014, pending in the court of learned Additional Sessions Judge-IX, Patna with a direction to conclude the trial as per observation made in order dated 28.03.2018 passed in Cr. Misc.
