JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-04-2022 Heard learned counsel for the petitioners and learned APP for the State.

Learned counsel for the petitioners are expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. It is a case of recovery of 101 litres of country-made liquor seized from the house of the accused Dinesh Mukhiya.

The name of the petitioners only came as other accused persons were engaged in the business of illicit liquor. They were not apprehended from the spot. They have clean antecedent. In the facts and circumstances of the case, let the petitioners, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Sathi P.S. Case No. 135/2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
