JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered The petitioner is languishing in jail custody since 2008-2015 in a case registered under Sections-448, 376/511 of the Indian Penal Code and the accusation against the petitioner is that he made attempt to commit rape upon the informant. Submission on behalf of petitioner is that the petitioner and the informant are co-villagers and as a matter of fact, there was some dispute between them on the point of flow of drainage water and that is the reason, the informant implicated the petitioner in this false case.

Considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.18659 of 2016 (3) dt.05-05-2016 2/2 of the case as well as submission of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Alipur P.S. Case No. 81 of 2015 corresponding to Sessions Trial No. 95 of 2016/155 of 2016to the satisfaction of Learned Additional District & Sessions Judge-IX, Gaya.
