JUSTICE PARTHA SARTHY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 01-08-2023 The writ petition is filed to command the respondents to remove the encroachment in a P.W.D. road in village Pokhrabhinda from Bans Ghat to the house of Ramchandra Singh, a teacher.

2. The road is said to be situated in BlockBathnaha, District-Sitamarhi. The allegation is that some persons have illegally encroached upon the said road and obstructing the free movement through the said road. The identity of the persons, who are carrying out the encroachment

3. The Public Interest Litigation has been filed in a casual manner without any material other than making bald allegations about encroachment on a road, without even specifying the location of the road or such details as to disclose its identity.

4. We find absolutely no reason to invoke the extraordinary writ jurisdiction under Article 226 of the Constitution of India.

5. The writ petition stands dismissed.
