Petitioners apprehend their arrest in connection with Paras Bigha P.S. Case No.121 of 2016, registered under Sections 304(B), 201 and 120(B) of the Indian Penal Code. Learned counsel for the petitioners submits that the husband and sister-in-law have been acquitted by the trial court. The informant turned hostile in the case, so the petitioners have renewed their prayer of bail though their prayer of anticipatory bail was rejected earlier.
It appears that the prayer of anticipatory bail of the petitioners was rejected by this Court by order dated 06.02.2017, passed in Cr. Misc. No.5396 of 2017, since then they had not
Patna High Court Cr.Misc. No.61596 of 2017 (2) dt.20-12-2017 2 /2 surrendered before the court below, so there is no ground for considering the anticipatory bail of the petitioners, so their prayer of anticipatory bail is rejected in connection with Paras Bigha P.S. Case No.121 of 2016, pending in the court of learned Judicial Magistrate, 1st Class, Jehanabad with a direction to the petitioners to surrender in the court below and seek regular bail and the same shall be disposed of on merit without being prejudiced by this order.
