Petitioner, already in custody, seeks bail in connection with Muffasil P.S. Case No.107 of 2017, registered under Sections 356 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that no mobile was recovered from possession of the petitioner rather it was recovered from one Priyanshu Kumar, who disclosed the name of the petitioner and except that there is no other material against the petitioner and the petitioner is in custody for last eight months approximately.

Having considered the said facts and circumstances, petitioner Aryan Kumar is directed to be released on bail on

Patna High Court Cr.Misc. No.11296 of 2018(2) dt.28-02-2018 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Muffasil P.S. Case No.107 of 2017 with condition that petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
