JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 27.01.2016 in a case registered under section 457 and 380 of the Indian Penal Code. The present case was lodged against the unknown person but in course of investigation, co-accused Sanjay Kumar Yadav was arrested and made his confessional statement and, thereafter, one co-accused Sonu Kumar was also arrested and he too made his confessional statement. The aforesaid co-accused stated that they had talked with one Khan and on the basis of aforesaid statement, the petitioner was arrested. Admittedly, nothing has been recovered from

Patna High Court Cr.Misc. No.19019 of 2016 (3) dt.13-05-2016 2/2 conscious possession of the petitioner and the investigation against him appears to have already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah in connection with Majhauliya P.S.Case No. 15 of 2016.
