JUSTICE ARUN KUMAR ORAL ORDER 28-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Complaint Case No. 1288 of 2013 registered under Sections 323 and 420 of the Indian Penal Code.
Allegation in brief is that petitioner sold the land to the complainant taking consideration amount of Rs. 2,40,000/- in the year 2009 but the said land was already sold to some other person. Submission is that petitioner is ready to return back the consideration money of Rs. 2,40,000/- taken by him from the complainant in five equal installment.
Having considered the facts that petitioner is ready to pay the consideration money, he is directed to be released on provisional bail after depositing Rs. 48,000/- by Bank Draft in the
Patna High Court Cr.Misc. No.12472 of 2018 (2) dt.28-02-2018 2/2 name of the complainant and upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Judge XV-cum-ACJM-XIV, Bhagalpur in connection with Complaint Case No. 1288 of 2013 and only remaining four installments of equal amount in subsequent four months thereafter, on payment of final installment, the court below shall confirm the provisional bail of the petitioner, otherwise petitioner's bail bond shall be cancelled.
