2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 354(A)/354B of the IPC, section 8 of the POCSO Act and section 3 (i)(r)(s) (w)/3(2) (va) of the SC /ST Act.
3. As per the prosecution case, petitioner tried to outrage modesty of minor daughter of the informant.
4. Learned counsel appearing for the petitioner submits that the parties are neighbour and due to petty dispute, petitioner has falsely been implicated in this case. However, they have compromised the dispute and a compromise petition (annexure 2) has also been filed in the Court below. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.52253 of 2023(4) dt.04-09-2023 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI cum Exclusive Special Judge, POCSO Act Patna in Special Case No. 78/2023 (Bakhatiyarpur Police Station Case No. 106 of 2023), subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
