JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act. Two country made pistols and eleven live cartridges are said to have been recovered from conscious possession of the petitioner, who does have criminal antecedent of near about 13 cases.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Warisaliganj P.S. Case No. 300 of 2015 pending in the court of Sub Divisional Judicial Magistrate, Nawada stands rejected.
