Petitioner is languishing in custody since 30.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 326, 307, 302, 504 of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that co-accused Awadhesh Yadav, Rajdeo Yadav, Arvind Ramani, Ajay Ramani, Munna Yadav and Rajendra Bind and this petitioner took toddy from the son of the informant Laldeo Chaudhary, but they did not want to make payment. On protest being made, the accused persons made indiscriminate firing, causing death of the son of the informant.

Patna High Court Cr.Misc. No.25209 of 2015 (2) dt.21-07-2015 It is submitted by the learned counsel for the petitioner that the accusation of firing is not specific against the petitioner, when co-accused Ajay Ramani, Shailendra Rawani and Rajeshwar yadav have been granted bail vide Cr. Misc. No. 16891 of 2014. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent and investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge S.C./S.T. Act-cum-Ist Additional Sessions Judge, Aurangabad in connection with Goh P.S. Case no. 129 of 2013. (Dinesh Kumar Singh, J) P.K./- U T
