Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a, 26, 35 of the Arms Act. The police raided the house of co-accused Naresh Yadav and firearm was recovered from there. On disclosure of Naresh Yadav, the house of the petitioner was also raided. The petitioner was apprehended. However, nothing was recovered from the possession of the petitioner. Petitioner is in custody since 17.12.2017.
Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees
Patna High Court Cr.Misc. No.13550 of 2018 (2) dt.09-03-2018 2/2 Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Obra Police Station Case No. 208 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
