The petitioner is accused of Kanti P.S. case No. 21 of 2015 instituted under sections 376 & 511 IPC lodged on 19.01.2015 by his uncle alleging that the petitioner tried to commit rape on 13/14-year-old daughter of the informant. Counsel for the petitioner submits that father of the petitioner and informant are full brother. It has been found during investigation that both of them are locked in land disputes. The police, on conclusion of investigation, submitted charge sheet only under sections 341,323 &354 IPC. The petitioner is in custody since 20.01.2015 having no criminal antecedent. No.10671 of 2015 (3) dt.20-10-5201 2 / 2 petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Spl. Judge, POCSO, Muzaffarpur in Kanti P.S. Case No. 21 of 2015, G.R. No. 07/2015 on condition that one of the bailors of the petitioner shall be his own/close family member. In event of framing of charge, he shall appear on each date fixed at the trial. Failure in appearance on two consecutive dates shall lead to cancellation of his bail bonds. During the subsistency of this privilege if the petitioner is found in any crime against the modesty of women the same shall be construed as breach of condition of bail entailing cancellation of his bail bonds.
