The petitioner apprehends his arrest in Nawadah Town P.S. Case No.416 of 2017 under Section 420, 409, 34 of Indian Penal Code.

The informant alleged that he was in search of job. He came close with Ranjeet Kumar @ Mantu, Bench Clerk of Dy. Collector, Land Reforms, Nawada and his brother Sunil Kumar @ Sanjay. Petitioner is a peon in the high school. Both accused persons took Rs.3 lacs from him but the informant did not get appointment letter. The informant came to know that many persons were cheated.

The learned counsel for the petitioner submits that there

Patna High Court Cr.Misc. No.55821 of 2017 (2) dt.12-12-2017 is no chit of papers to show that petitioner received any money from the informant or any other person. The brother of the petitioner, Ranjeet Kumar @ Mantu has already been granted anticipatory bail by the order dated 22.08.2017 passed in Cr. Misc. No.39555 of 2017. Case of the petitioner stands on the same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Nawadah Town P.S. Case No.416 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
