Heard learned counsel for the petitioner as well as learned APP for the State.

At the very outset, Mr. J.N. Thakur, learned APP has submitted that the case diary has been received and as per paragraph No. 177 of the case diary the process under Section 83 of the Cr.P.C. has already been executed. As such, the present anticipatory bail petition is not maintainable. Accordingly, it is dismissed as not maintainable. If the petitioner surrenders and seeks regular bail before the court below, his bail petition shall be disposed of on its own merit without being prejudiced by this order.

Patna High Court CR. MISC. No.5910 of 2021(5) dt.02-03-2022 2/2 Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
