The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420/409 of the Indian Penal Code.
As per the prosecution case, this petitioner temporarily embezzled government money of Rs. 3,65,000/-. It is submitted that the alleged amount was withdrawn as the team of the Animal Farmers of the district were going for training at Karnal in the State of Haryana, Silliguri, West Bengal, Nagpur and Patna for which reservation etc. was to be taken, but in the meantime, petitioner was transferred from Aurangabad and was attached in the Headquarters and said
Patna High Court CR. MISC. No.48828 of 2022(2) dt.13-12-2022 2/2 amount was not utilized and subsequently, deposited in the concerned account. It is next submitted that a departmental proceeding was initiated against the petitioner and all the documents were examined and the enquiry officer submitted his enquiry report. The enquiry report was finally accepted by the Disciplinary Authority and punishment of withholding two increments with cumulative effect was given. Petitioner has already been punished and he bears clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur, Bhabhua in connection with Bhabhua P.S. Case No. 317 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
