The petitioner apprehends his arrest in Araria P.S. Case No.621 of 2018 registered under Section 379 of the Indian Penal Code.

The case was registered against unknown for the theft of the motorcycle of the informant.

The learned counsel for the petitioner submits that during the course of investigation, the motorcycle was recovered from one Ritesh Mandal. Ritesh Mandal disclosed the name of the petitioner but it appears that petitioner has got criminal antecedent and he is accused in Araria P.S. Case No.760 of 2018 registered under Sections 379 and 411 of the Indian Penal Code.

Taking into consideration the fact that of course the

No.47260 of 2019(2) dt.30-07-2019 2/2 name of the petitioner figured in the case on the confessional statement of co-accused but the petitioner has got criminal antecedent and he is accused in another case of similar nature, therefore, I am not inclined to enlarge the petitioner on anticipatory bail.
