JUSTICE SUDHIR SINGH ORAL ORDER 19-08-2015 The petitioners are in custody since 20.4.2015 in Mirganj P.S. Case No.97/15 for the offences under Sections 366, 366(A)/34, 302 of the I.P.C. and Section 3(1)(xi) of the Scheduled Castes and Scheduled Tribes Act.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that there is allegation against the petitioners of enticing the daughter of the informant, namely, Sonam Kumari, with intent to marry her. It is submitted on behalf of the petitioners that they are in custody since 20.4.2015 and charge sheets have been submitted in this case. It is further submitted that in the present case the informant who happens to be the father of the deceased
Patna High Court Cr.Misc. No.24630 of 2015 (3) dt.19-08-2015 2/2 girl has himself confessed his guilt that he himself has killed his daughter due to her love affairs. The aforementioned fact has been supported by Annexure-2 to this petition.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj, in Mirganj P.S. Case No.97/15.
