Petitioner, already in custody, seeks bail in connection with Kalyanpur P.S. Case No.187 of 2017, registered under Section 394 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is a student of I.Sc., neither any incriminating article has been recovered from his possession nor he was put on TIP, only on the basis of confessional statement, the petitioner has been made accused, prior to institution of this case, he had no criminal antecedent, only after institution of this case the petitioner was made accused in another case and he is in custody since
Patna High Court Cr.Misc. No.13300 of 2018(2) dt.07-03-2018 2/2 30.10.2017.
Having considered the said facts and circumstances, petitioner Raja Singh @ Dhananjay Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Assistant Chief Judicial Magistrate, 9th, East Champaran at Motihari in connection with Kalyanpur P.S. Case No.187 of 2017.
