2. Office has pointed out certain defects.
3. Learned counsel for the petitioner submits that it is an old matter of the year 1970 and a number of substitutions have taken place and it is almost impossible to verify the position as the same is not even clear from the copy of plaint. It has been further submitted that the original copy of the plaint is not available on the record even before the learned trial court. Learned counsel further submits that the petitioner has approached this Court with simple prayer for early disposal of Title Partition Suit No. 202 of 1970 which is pending even after 54 years. Learned counsel further prays for ignoring the defects and passing order with direction to the learned Sub-Judge IV, Rosera, Samastipur to dispose of Title Partition Suit No. 202 of 1970 at the earliest.
4. Since the petitioner has come before this Court with
4/4 limited prayer for expeditious disposal of the Title Partition Suit No. 202 of 1970, I do not think there is any need to issue notice to the respondents.
5. In the light of submission made on behalf of the petitioner, the defects pointed out by the office are ordered to be ignored and learned Sub-Judge IV, Rosera, Samastipur is directed to dispose of Title Partition Suit No. 202 of 1970 at the earliest, preferably, within six months from the date of receipt/production of a copy of this order keeping in mind the guideline contained in Action Plan for Arrears Reduction in District Judiciary of the Hon'ble Supreme Court, wherein it has been directed for expeditious disposal of the cases pending for more than 30 years.
6. With the aforesaid direction, the present petition stands disposed of.
