2. The petitioners are seeking regular bail in connection with S.T. No. 240 of 2025/ C.I.S. No. 240 of 2025 arising out of Sarsi P.S. Case No. 191 of 2024, registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 117(2), 109, 74, 303(2) and 103 of the BNS.

3. As per the prosecution case, co-accused Mushaharu Ram took the informant's husband with him and thereafter the informant heard the shouting of her husband. When the informant's devar and nandoi (brother-in-law) went to rescue, accused persons made them hostage and started assaulting with lathi, danda, iron rod

Patna High Court CR. MISC. No.48046 of 2025(3) dt.19-01-2026 2/3 and sword causing severe injury to them. It is further alleged that they snatched golden chain and Rs. 10,000/- from them. During treatment, the informant's husband and devar died.

4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Three co-accused persons have been granted bail on similar footing, by a co-ordinate Bench of this Court vide order dated 23.07.2025 passed in Cr. Misc. No. 44021 of 2025. Four other coaccused persons have been granted bail by a co-ordinate Bench of this Court vide order dated 06.05.2025 passed in Cr. Misc. No. 27007 of 2025. It has further been submitted that period of custody of other co-accused persons who have been granted bail, is lesser than the present petitioner. He has also submitted that the petitioners are persons of clean antecedents and are under custody since 20.10.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioners above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioners on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Purnea/concerned Court, Purnea in connection with S.T. No. 240 of 2025/ C.I.S. No. 240 of 2025 arising out of Sarsi P.S. Case No. 191 of 2024, subject to the following
