2. The petitioner is apprehending his arrest in connection with Town P.S Case No. 139 of 2025 dated 07.03.2025 registered for the offence punishable u/s 126(2), 115(2), 118(1), 109(1), 303(2), 74, 352, 351(2) read with Section 3(5) of B.N.S.
3. As per the prosecution case, while the father-inlaw of the informant was on his way to home, six FIR named accused persons variously armed with deadly weapons badly assaulted him. It is further alleged that on hearing hulla when the informant came to rescue, she was also assaulted by the petitioner and the co-accused persons and her golden chain
Patna High Court CR. MISC. No.48082 of 2025(2) dt.29-08-2025 2/3 was snatched.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case on account of land dispute. Petitioner is a lady. There is case and counter case between the parties. There is general and omnibus allegation against the petitioner. The specific allegation of assault is against co-accused Vijay Kumar Singh. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. Similarly situated other co-accused person has been granted regular bail by this Court vide order dated 22.08.2025 passed in Cr. Misc. No. 46448 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Aurangabad in connection with Town P.S. Case No. 139 of 2025, subject to conditions as laid down under
Patna High Court CR. MISC. No.48082 of 2025(2) dt.29-08-2025 3/3 section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
