Mr. Prasad states that a counter affidavit has already been filed which would indicate that illegalities/irregularities in selecting the beneficiary of Indira Awas Yojana have already been looked into and rectified. He has also objected to the petition filed by the petitioner on behalf of the beneficiaries alleging

Patna High Court CWJC No.6967 of 2014 (3) dt.26-10-2016 illegalities/irregularities in selection of the beneficiary of Indira Awash Yojana.

In my view, such application, at the instance of the petitioner, would not be maintainable. That apart, from the averments made in the counter affidavit, this Court is satisfied that the respondents have addressed the irregularities pointed out by the petitioner.

The application is dismissed.
