JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Dhansoi P.S. Case No. 28 of 2001 for the offenses under Sections 366A/34 of the Indian Penal Code.

The petitioner was granted bail by the Chief Judicial Magistrate, Buxar on 4.7.2001. It is alleged that he remained absent in the court proceeding and as such his bail bond was cancelled.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner was not served summon at the stage of first appearance and his bail bond was cancelled. The petitioner surrendered on 25.02.2019 after 18 years.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Dhansoi P.S. Case No. 28 of 2001, subject to the following conditions:- (i) Bailors shall be the family members;

(ii) The petitioner shall assist the court below in early conclusion of the trial and appear on each and every date fixed and shall not absent himself without any cogent reason. (iii) The Court below shall take coercive step if the petitioner neglects the proceedings and does not attend the Court proceeding without any cogent reason.
